Using this website
You are welcome to read this site, quote it with attribution, and send us an enquiry. You may not scrape it to train a model you intend to sell, copy the copy or the design wholesale into a competing site, or attempt to interfere with how it runs. Using the enquiry form to send bulk sales messages is not an enquiry.
What is on this site is not an offer
The prices published here are indicative, stated in US dollars and current at the date above. They describe what the work usually costs, not a binding quotation. The binding number is the one in a written proposal with your name on it, and that proposal is what forms the contract.
How engagements work
- Monthly plans run month to month. Either side can end them with thirty days written notice. There is no minimum term and no lock in.
- One time builds are quoted against a written scope. Changing the scope changes the price, and we will say so before doing the work rather than after.
- Invoices are payable within fourteen days unless the proposal says otherwise. Work on a materially overdue account may be paused, and we will tell you before pausing it.
Who owns what
You own everything we make for you — the positioning, the identity, the copy, the designs, the photography, the film and the source code — from the moment the invoice covering it is paid in full. That transfer is outright and unconditional.
We keep ownership of the general methods, frameworks, templates and tooling we bring to the work and use across clients. Those are not part of your deliverables and you do not owe us anything for their use inside your project.
Third party components — typefaces, stock assets, libraries, hosting and software subscriptions — stay with their licensors. We will tell you what those are and what they cost to keep.
Unless your proposal says otherwise, we may name you as a client and show the finished work in our portfolio. Say no and we will not; you can withdraw that permission at any time.
What you are responsible for
That you have the right to give us the material you give us, that the facts and claims you ask us to publish are true, and that you get us approvals and feedback within the times the plan sets out. We build on what you provide; we cannot verify claims about your own business for you.
What we promise, and what we do not
We promise the work will be performed with reasonable skill and care by people who know how to do it, and that we will tell you the truth about what is and is not working, including when the truth costs us the retainer.
We do not promise specific commercial results. Nobody honest does. Rankings, reach, enquiry volume and revenue depend on your market, your offer, your delivery and your pricing, and most of those are yours to control rather than ours. Any figure we discuss is a forecast, not a guarantee.
This site is provided as it is. We do not warrant that it will be uninterrupted or error free.
Limitation of liability
Nothing here limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited.
Subject to that, neither side is liable to the other for indirect or consequential loss, or for loss of profit, revenue, goodwill, data or anticipated savings, however caused. Our total liability in connection with an engagement is capped at the fees you paid us under it in the twelve months before the claim arose.
Confidentiality
Each side keeps the other's non-public information confidential, uses it only for the work, and returns or destroys it on request. This survives the end of the engagement.
Ending an engagement
Either side may end an engagement on thirty days written notice, or immediately if the other commits a material breach and does not fix it within fourteen days of being told. On termination you pay for work completed and costs already committed, and we hand over everything you have paid for in a usable form.
Governing law
These terms and any engagement under them are governed by the laws of the United Arab Emirates, and the courts of Dubai have exclusive jurisdiction. If a dispute arises we will both try to resolve it in a conversation before either of us involves anyone else.
Changes
We may update these terms for future engagements and will change the date at the top when we do. The terms attached to your signed proposal are the ones that govern your engagement, and we cannot change those unilaterally.
